TERMS AND conditions




Article 1 - Scope


These terms and conditions determine the conditions under which the company of Mr. Hrant BALOZIAN bearing the trademark "VIP Latitude" offers to any customer engaging an order with him for professional purposes the sale of various manufactured goods and foodstuffs.

They prevail and are full part of all purchases involved with "VIP Latitude" by telephone, E-mail or via the website www.viplatitude.com.

The parties expressly agree that their relations are exclusively governed by these Terms and Conditions, with the exception of any other contractual document. The purchase of a Product by a Customer assumes full and unconditional acceptance of these Terms and Conditions.

By ordering a product or service on the site www.viplatitude.com and by clicking the box "I accept the Terms and Conditions" or by placing any order by telephone, the Customer declares to have read these Terms and Conditions and accepts them without restriction.


Article 2 - Validity date of these Terms


These General Terms and Conditions (GTC) have been prepared as of March 1rst, 2020.

"VIP Latitude" reserves the right to modify these Terms at any time without notice, provided that such changes will not apply to orders previously confirmed.


Article 3 - Order


3.1 Any order may be placed by the Customer via the website www.viplatitude.com, orally by telephone or in writing (letter or E-mail).

An order will be considered accepted only after formal written confirmation by "VIP Latitude". Following his oral or written order, the Customer will receive this confirmation by E-mail at the electronic address indicated with the Client’s order, in French or English, with the essential characteristics of the products to be delivered.

For any first order, the Customer agrees to send to VIP Latitude by E-mail or by fax the RCS, APE code and VAT number of the company making the order or, for any corporation non-governed by the French law, any other legal and recognized document proving the existence of the company.


3.2 The registration of an order on the website www.viplatitude.com intervenes only when the Customer agrees during the ordering process, by clicking the box, to these General Terms and Conditions. This validation implies full acceptance of all of these sale conditions and is evidence of the execution date.

"VIP Latitude" confirms to the customer by E-mail the receipt of the order at the electronic mail address provided and sends him a summary of his order including the essential characteristics of the products to be delivered.


Article 4 - Price


Prices are in Euro.

Delivery costs are not included in the prices listed on the product pages.

The products remain the property of "VIP Latitude" until full payment by the client is received.

For all orders with a delivery time of less than 6 hours, prices will be automatically increased by 50%.


Article 5 – Delivery place


The exact delivery address must be clearly indicated by the customer at the time of the order. "VIP Latitude" rejects any liability or any compensation in case of delay due to incomplete or erroneous information provided by the Client.

A hard copy of the delivery bill is enclosed with the delivery. The Customer must check the goods before signing the delivery bill. The Customer shall express any reserve about the condition of the goods on the delivery bill. Without any written reserve on the delivery bill, "VIP Latitude” will not consider any claim.Article 6 – Delivery time

The terms of delivery will be specifically agreed between the parties for each order.

"VIP Latitude” can not be held responsible for a failure in delivery due to a force majeure, nor be held responsible for delays that are independent of its will, such as strikes, weather conditions, road accidents, traffic jams, detours, denial of access or any others.


Article 7 - Costs and delivery areas


The delivery fees are at the cost of the Customer and will be charged by "Latitude VIP" for each order. The amount of delivery fees depends upon the airport where an order is to be delivered and will be previously mentioned for each order placed by the Customer.


Article 8 - Courier costs


Some orders with "VIP Latitude" may require the use of courier or mail services (internal or external) to supply one or more products necessary for the completion of the order.

These courier costs will be charged to the Customer at the rates applied by "VIP Latitude", once presented to the Client and accepted by this one at the time of the order.


Article 9 - Product Features


The Customer acknowledges to be informed beforehand that all food products supplied by "VIP Latitude" are intended for immediate consumption.

They are delivered in suitable containers for food saving and preservation during a few hours and for heating if necessary. "VIP Latitude" formally undertakes to comply with health and safety Food regulation required by the HACCP standards for the production, packaging and transportation of its delivered products.

For safety and sanitary reasons, no good will be taken back or exchanged.

In case of food allergies, it is imperative to inform beforehand "VIP Latitude" at the time of the order. Without this information, "VIP Latitude" disclaims all liability for damages of any kind that may result from the consumption of its products by the Customer.

Product pictures posted on the website are not binding but accurately reflect the reality of the products prepared by "VIP Latitude."

Some products offered for sale by "VIP Latitude" may be unavailable due to the their seasonality and their market availability

."VIP Latitude" reserves the right to change the composition of the menus ordered by a Customer, depending upon variations of supply conditions and product seasonality, but not without having informed the customer before and received his agreement.

In any case, unavailability of one or more product may not engage the responsibility of "VIP Latitude".


Article 10 - Billing and Payment


The settlement is made in cash or by credit card upon receipt of the bill. Invoices are submitted at the same time as the products are delivered.

All prices are free of VAT. The bills include in French the words: « TVA non applicable en vertu de l’article 293 B du CGI » (“VAT not applicable under section 293 B of the French CGI”).

At the time of order, “VIP Latitude” may request a down payment corresponding to the amount of the order to secure its payment. This deposit may be made by a pre-payment of the order or through the use of a bank credit card.

In case of order cancellation by the Client, "VIP Latitude" will be allowed to retain the deposit in part or in whole or charge the Client's credit card for the amount of the corresponding cancellation costs, according to the terms of Article 11 below.

Any eventual due balance on an order will be payable right away at delivery in cash or by credit card.

The prices charged by "VIP Latitude" are in Euro. All orders, regardless of the Customer’s domicile, are payable exclusively in Euro.

Any claim related to "VIP Latitude" products, services or billing should be addressed to the company in writing within a ONE-YEAR period beginning on the delivery date or on the invoicing date.


Article 11 - Order Cancellation or Amendment


In case of order cancellation within less than 18 hours before the scheduled delivery time, 50% of the total order price will be due by the Client to "VIP Latitude."

In case of order cancellation within less than 9 before the scheduled delivery time, the full order price will due by the Client to “VIP Latitude”.

In case of cancellation the order of special produst or service not part of the Menu, the full order will be due after its confirmation by VIP Latitude.

Notice for any amendment to add or remove items on a confirmed order must be given within a minimum of two hours before delivery time. After this delay, any order decrease will be charged as for a cancellation case, according to the terms of Article 11 below.


Article 12 - Claims


Any claim about an order and / or delivery may be made to “VIP Latitude” by phone at: + 33 (0) 6 59 29 58 62 and must be confirmed in writing.

Article 13 - Personal data


"VIP Latitude" ensures that recorded information is reserved exclusively for its commercial use and is not disclosed to any third party.

"VIP Latitude" web service uses computing means to ease the management of the relationships with its visitors and customers.

In accordance with Articles 39 and following of the French law n ° 78-17 dated January 6th, 1978 relating to data, files and freedom, any Person has the right to obtain and when appropriate correct or delete any information concerning his data, by writing to the following address: 3 - Pôle Aviation Générale, Aéroport Marseille Provence, 13700 Marignane, France.


Article 14 - Miscellaneous Obligations and dispute resolution


If any provision of these Terms and Conditions is found unenforceable for any reason whatsoever, all other provisions will remain applicable.


These Terms and Conditions shall be governed and interpreted by French law.


Any action arising from the interpretation, performance or non-performance of these Terms and Conditions, as well as prosecution for damage incurred as a result of the use of the products, must be brought before the Tribunal de Commerce de Marseille (France).
